Abstract

Artificial Intelligence in The Banking Sector (Evidence From Ukraine)

Alona Klochko

The need for modernization of the Ukrainian banking sector is underpinned with the necessity of its effective protection from both internal and external threats, including those caused by the imposition of the martial law. This need also results from the status of a candidate for EU membership acquired by Ukraine, which opens up opportunities for the National Bank of Ukraine to implement the relevant European integration processes in the financial sphere. The research aims to analyze the current state and prospects for the further implementation of artificial intelligence (AI) technologies in the banking sector of Ukraine, in particular for the prevention of criminal offenses. The method of comparative law is used to analyze the legal framework for AI regulation in Ukraine and other countries. Following the results of the research, specific proposals were formulated regarding criminal liability associated with the application of artificial intelligence. The current state of AI application in the Ukrainian banking is determined. Specific directions of the strategy for the development of the Ukrainian banking through the use of AI technologies are proposed, which focus on improvement of functioning, and their essence is outlined. The implementation of the proposed measures relating to the strategy for the development of the banking sector will allow for the future significant improvement of interaction between banking institutions and consumers of banking services, in particular, support of the users on any issues arising in the process of their use, assessment of the borrower credibility risks, financial advice, timely detection and prevention of fraud and other activities of banking institutions of Ukraine. It can also contribute to the timely monitoring of legal documents and the latest changes in the current banking law.
